1. Who you are contracting with
These Terms govern your use of the Revenue Leak Scanner and related services (the "Service") provided by Elgie Young("we", "us", "our"). By using the Service you agree to these Terms.
2. The Service
The Service analyses a website you submit and produces a revenue leak report. Reports are provided for informational purposes; you remain responsible for any decisions you make based on them.
3. Acceptable use
You agree not to:
- use the Service for any unlawful purpose, fraud, or spam;
- infringe the intellectual property or other rights of any party;
- interfere with or attempt to compromise the security of the Service, including by introducing malware, probing, scanning, or scraping;
- resell, redistribute, or reverse engineer the Service;
- submit URLs or content you do not have the right to submit.
4. Accounts and accuracy
You must provide accurate information, keep it up to date, and maintain the confidentiality of any account credentials. You are responsible for activity under your account.
5. Intellectual property
We retain all right, title, and interest in the Service, including software, documentation, and branding. You receive a limited, non-exclusive, non-transferable right to use the Service.
6. Payments & Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms in addition to these Terms.
7. Service availability
We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your expectations. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or engage in repeated or serious policy violations. You may stop using the Service at any time.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.
10. Indemnity
You agree to indemnify us from claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which Elgie Young is established, without regard to conflict-of-law rules.
12. Changes
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance.
